Richemont could not compel eBay to police their sellers. Richemont had already lost their lawsuit against eBay in 2008.

Tiffany Inc. v. eBay Inc., 600 F.3d 93, established that trademark owners have the burden of policing for counterfeit items when their products are sold in an online marketplace. United States Court of Appeals for the Second Circuit.
eBay does not have to police their sellers. The trademark owners must do that through a program known as VeRO (Verified Rights Owners).
Richemont took eight years to go after the sellers of Parnis watches, but when they did, the watches came down. The Company and its subsidiaries jumped on a court docket on 11 November 2016, and before the defendants could respond, Richemont received a default judgment on 25 January 2017.
